TOKYO, June 15, 2017 – Canon today announced that it obtained a preliminary injunction, which inter alia contains injunctive relief, granted by the District Court Düsseldorf against M & S Vertrieb Service OHG. The preliminary injunction is based on the infringement of the German portion of Canon's European patent 2 087 407 relating to a drum unit and a process cartridge. The accused act consists of the offer and distribution of laser toner cartridges comprising a drum unit via Amazon.de under the ASIN (=Amazon Standard Identification Number) B00I9BN11C, B00HFN56UE, B00IHWSUCS, B06WVB3JRW, B00IHXOQFW and B01BGQLB0O. Those cartridges replace the cartridge models HP CF226A, HP CE255X, HP CF280A, HP CF280X, HP CF287A, HP CE505A and HP CE505X compatible with HP laser beam printers.
The preliminary injunction granted by the District Court Düsseldorf is not yet final. Canon can enforce the decision after service of the PI on the Defendants.
