Canon announces conclusion of patent infringement dispute in Germany

TOKYO, August 26, 2015—Canon Inc. today announced the successful conclusion of a patent infringement dispute (4a O 72/14) in Germany pending before the District Court of Düsseldorf against Mr. Thomas Zenkel, owner of the domain “tintenalarm.de”, concerning the German portion of Canon's European patent 2 087 407 relating to, inter alia, a drum unit. The lawsuit concerned among other things, the offering and sale of certain toner cartridges with said drum units for use in various models of Canon and Hewlett-Packard German laser beam printers.

In its ruling, dated June 11, 2015, the Court decided that Mr. Zenkel acting under “ tintenalarm.de” is prohibited from using, selling and offering the infringing photosensitive drum units in Germany and ordered Mr. Zenkel to recall said products from the distribution channel. A declaratory decision on liability for damages is also included in the decision. The decision became final, while other cases based on this patent are still pending.
